These Terms of Service (“Terms”) govern your access to and use of the website at https://hockey.sportsillustratedprospects.com and any events, programs, services, and communications offered by 2653954 Ontario Inc., operating as Elite Global Sports (“Elite Global Sports”, “we”, “us”, or “our”). By accessing the site, registering for an event, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the site or services.

1. About us and brand licensing

Elite Global Sports is a division of 2653954 Ontario Inc., a Canadian corporation. Elite Global Sports operates Prospects by Sports Illustrated hockey events in Canada under license from Authentic Brands Group / ABG-SI LLC and affiliated Sports Illustrated entities. References on this site to “Prospects by Sports Illustrated”, “PSI”, “Sports Illustrated”, or “SI” refer to events, programs, and content operated or produced by Elite Global Sports under that license. Sports Illustrated and related trademarks are the property of their respective owners.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to register for an account or event in your own name. If you are under 18, a parent or legal guardian must register on your behalf and agree to these Terms on your behalf. By registering a minor, the parent or guardian represents that they have full legal authority to do so and to bind the minor to these Terms.

3. Registration and accuracy of information

When you register for an event or submit a form, you agree to provide accurate, current, and complete information, and to update it as needed. We may refuse, suspend, or terminate access to events or services if information provided is inaccurate, incomplete, or in violation of these Terms.

4. Event registration, fees, and payment

Event registration fees, dates, locations, and details are posted on the relevant event page. Registration is not confirmed until payment is received and we issue a confirmation. We may modify event dates, locations, formats, or pricing prior to your registration. Material changes to events after registration will be communicated to registered participants by email and/or SMS where you have opted in.

5. Refunds and cancellations

Unless otherwise stated on the event registration page or in a written agreement signed by Elite Global Sports:

• Registrations cancelled by the participant more than 14 days before the event start date are eligible for a refund of the registration fee, less any non-refundable processing fees;
• Registrations cancelled by the participant within 14 days of the event start date are non-refundable;
• If Elite Global Sports cancels an event in full and does not offer an equivalent rescheduled date, registered participants will receive a full refund of registration fees paid;
• If an event is postponed or rescheduled, registrations will be honored for the new date. Participants unable to attend the rescheduled event may request a refund within 14 days of the rescheduling notice;
• Refunds are issued to the original payment method and may take up to 14 business days to appear.

6. Assumption of risk

Ice hockey is a contact sport that involves inherent risks, including but not limited to physical contact, falls, contact with the puck, sticks, boards, ice, or other participants, and serious injury including head, neck, and spinal injuries. By registering for or participating in any event operated by Elite Global Sports, you (and if you are a parent or guardian registering a minor, you on behalf of the minor) acknowledge and accept these risks. Participants and guardians may be required to sign an additional waiver and release of liability at or before the event. These Terms do not replace or limit the terms of any such waiver, which will apply in addition to these Terms.

7. Code of conduct

All participants, parents, guardians, and spectators are expected to conduct themselves respectfully and lawfully at our events. We reserve the right to refuse entry, remove from the event, or permanently exclude any individual whose conduct we determine, in our reasonable discretion, to be unsafe, disruptive, harassing, discriminatory, or otherwise inconsistent with the values of our programs. No refund will be issued where removal results from violation of this Code of Conduct.

8. Photo, video, and media release

By registering for, attending, or participating in any event operated by Elite Global Sports, you grant Elite Global Sports, Prospects by Sports Illustrated, and their authorized licensees and media partners a perpetual, royalty-free, worldwide license to capture, use, reproduce, distribute, and display photographs, video, audio, and other media of you (and if applicable, your minor participant) for promotional, editorial, broadcast, and archival purposes, in any media now known or later developed, without further notice or compensation. To request reasonable removal of a specific image from materials we control going forward, contact webmaster@prospectsbysi.com.

9. SMS Terms & Conditions

2653954 Ontario Inc., operating as Elite Global Sports, provides youth athlete scouting events, hockey combines, and athlete development programs under the licensed brand Prospects by Sports Illustrated.

By opting in to receive SMS communications from 2653954 Ontario Inc., you agree to receive text messages related to your participation in Prospects by Sports Illustrated hockey events and programs operated by Elite Global Sports. These messages may include event confirmations, registration updates, scheduling reminders, athlete evaluation notifications, and important program updates.

You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, simply sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies depending on event registration activity and scheduling updates. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Mobile information and SMS opt-in consent will not be shared with third parties for marketing or promotional purposes.

10. Intellectual property

The site, including all text, graphics, logos, images, video, software, and other content, is owned by Elite Global Sports, its licensors (including Authentic Brands Group / ABG-SI LLC for Sports Illustrated brand assets), or its content providers, and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any part of the site without our prior written consent, except for personal, non-commercial use as expressly permitted by these Terms.

11. User-submitted content

If you submit content to us through a form, email, or other channel (including but not limited to resumes, application materials, hockey video, written submissions, or testimonials), you grant Elite Global Sports a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, and display that content for purposes reasonably related to operating our events, services, and promotional activities. You represent that you own or have all necessary rights to the content you submit and that it does not infringe the rights of any third party.

12. Acceptable use

You agree not to use the site or services to:

• Violate any applicable law or regulation;
• Infringe the intellectual property, privacy, or other rights of any person;
• Transmit any virus, malware, or other harmful code;
• Attempt to gain unauthorized access to the site, accounts, or related systems;
• Use any automated means to scrape, harvest, or collect information from the site;
• Impersonate any person or misrepresent your affiliation;
• Engage in conduct that is harassing, abusive, defamatory, or harmful to others.

13. Third-party links and services

The site may contain links to third-party websites and services that we do not control. We are not responsible for the content, policies, or practices of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that party’s terms and policies.

14. Disclaimers

To the maximum extent permitted by applicable law, the site, events, and services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any information provided is accurate, complete, or current.

15. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Elite Global Sports, 2653954 Ontario Inc., their affiliates, officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site, events, or services, even if advised of the possibility of such damages. Our total aggregate liability for any claims arising out of or related to these Terms or your use of the site or services will not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100). Nothing in these Terms limits any liability that cannot be limited under applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Elite Global Sports, 2653954 Ontario Inc., and their affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your violation of these Terms, (b) your violation of any law or the rights of any third party, or (c) your use or misuse of the site, events, or services.

17. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the site or services will be brought exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

18. Severability and waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not constitute a waiver of that right or provision.

19. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be communicated through this page or through other reasonable means. Your continued use of the site or services after the changes take effect constitutes acceptance of the revised Terms.
